Most people envision lawyers arguing in courtrooms; while this may be true for some lawyers, others specialize in other areas of practice.

A lawyer’s salary varies widely based on multiple factors, including region and practice setting, industry and type of case (for instance criminal attorneys tend to earn more than immigration attorneys).

David Boies

David Boies is one of the most in-demand lawyers in America, a famed litigator renowned for his victories and high-profile clients that have made him a media darling. His client list has included Al Gore, George Steinbrenner and CBS. However, his reputation has suffered significantly in recent years.

Boies is co-chairman of Boies Schiller Flexner LLP in New York and charges more than $2,000 an hour – one of the highest paid attorneys in America. Boies’ assets include two multi-million dollar homes in Manhattan and Westchester as well as a 900 acre California winery he owns for himself, plus his 184 foot yacht which travels globally.

Since being co-founded with partner Jonathan Schiller in 1997, this firm has quickly become a litigation powerhouse. From representing Al Gore in his Supreme Court challenge over 2000 presidential election to successfully filing antitrust violations lawsuit against Microsoft for antitrust violations – The New York Times once even called them “Bruce Springsteen media darlings.”

But recently, Boies has experienced several unfortunate circumstances that have cast his public reputation into question. Between 2017 and 2018 his firm was embroiled in several controversies relating to its representation of Hollywood producer Harvey Weinstein and founder Elizabeth Holmes from blood testing company Theranos (which collapsed this year after it was revealed as fraudulent). Journalist John Carreyrou detailed Boies and his team’s aggressive strategies used against critics of Theranos founder Elizabeth Holmes in an expose authored for The Wall Street Journal by John Carreyrou.

While he may seem charming in media interviews, he can be brutal on the stand. Known for his intense cross-examinations – even reporters humming the Jaws theme song while watching him question a witness in one trial – his ferocity can sometimes even impress veteran trial lawyers.

Boies has seen his firm’s revenue decline significantly in recent years. According to The American Lawyer, last year it totaled $220 million – down from $420 million in 2014 due to several rainmakers leaving for other firms and taking their clients with them. Yet Boies remains an invaluable force, particularly through his pro bono representation of Virginia Giuffre and other victims who suffered sexual abuse at Jeffrey Epstein’s hands.

Mr. Rosenblatt has also helped his clients fend off class-action lawsuits and federal investigations, with clients such as Disney, Warner Bros, Apple and Twentieth Century Fox among his roster. Furthermore, he has represented celebrities and public figures from Scarlett Johansson to singer KE$HA as clients.

Last year, Mr. Gosselin secured a $69 million settlement for Fox in their battle with producers of Bones TV show – this battle being led by actors and writers involved on Bones who claimed Fox had underpaid them for their services.

Judge Lake may deny Petrocelli his request for $30 million, yet another case in which lawyers’ fees in white-collar fraud cases have been reduced dramatically by judges. Most recently, in late September a judge reduced former HealthSouth CEO Richard Scrushy’s request of $32 million to approximately half that amount.

Petrocelli has long supported Democrats and Hillary Clinton specifically, according to FEC records. His most recent contribution, made on January 11, came just days after joining Trump University’s legal battles.

Dan Petrocelli ’80 recently won the American Lawyer’s 2020 Litigator of the Year award at an Industry Awards ceremony hosted by Kal Penn (Harold & Kumar 24) online. He spoke with SW LAW BLOG about this honor as well as providing some professional tips.

Jeffrey Mandell
